MASTHEAD MEMBER TERMS OF SERVICE

Version 1.0 — Effective from: [date member accepts]

These Terms govern your use of Masthead's membership service. By becoming a Member, you agree to these Terms.

1. What Masthead is

Masthead is an editorial concierge that composes cited reading dossiers from a curated index of luxury and cultural publications. Members get unlimited access to compose dossiers, save them as personal issues, and access additional features as they're released.

Masthead is operated by [Masthead's Cyprus legal entity name], a company incorporated in the Republic of Cyprus.

2. Membership

Free trial: New Members receive their first three months of membership at no charge, with payment details on file. We charge €12 monthly thereafter, or €120 annually if you select an annual plan.

Charges: Subscription charges renew automatically until you cancel. Charges are non-refundable except where required by law (see Section 5).

Changes to pricing: We may change Membership pricing with at least 30 days' written notice to your registered email address. Continued use of Membership after the notice period constitutes acceptance of the new pricing. If you don't accept the new pricing, you may cancel before it takes effect.

3. What Members can do

As a Member, you can:

— Compose unlimited concierge dossiers from Masthead's index

— Save dossiers to a personal issue collection

— Access Member-only features as they are released

— Cancel at any time via your account or by emailing info@masthead.studio

4. What Masthead provides

We work to provide:

— A working concierge service available continuously, with reasonable maintenance windows

— Accurate citation of source publications in every composed dossier

— Reasonable response times for support requests sent to info@masthead.studio

We don't guarantee the service will be uninterrupted or error-free. Where service is materially degraded for an extended period, we will work to make it right — including credit on your account.

5. Cancellation and refunds

You may cancel your Membership at any time. After cancellation:

— You retain access through the end of your current billing period

— Your saved issues remain accessible until end of billing period; after that, they may be archived or deleted

Refunds are available in two cases:

1. EU/UK consumer right of withdrawal: Where you are a consumer protected by EU or UK consumer law, you have 14 days from initial subscription to withdraw with a full refund. To exercise this right, email info@masthead.studio within 14 days of subscribing.

2. Material service failure: Where the service is materially unavailable for more than 7 consecutive days, you may request a pro-rata refund for the affected period.

Outside these cases, refunds are at Masthead's discretion.

6. Acceptable use

By using Masthead, you agree:

— Not to attempt to circumvent rate limits, scrape the index in bulk, or automate compose requests beyond personal use

— Not to share your account credentials or resell access to your Membership

— Not to use Masthead to generate content for purposes that violate any law, infringe any third party's rights, or facilitate harm

— Not to attempt to reverse-engineer Masthead's compose engine, access systems beyond the public interface, or otherwise interfere with the service

We reserve the right to suspend or terminate Memberships for violations of this section, with notice where reasonable.

7. Content and intellectual property

What's yours: Your saved issues (the dossiers you've pinned, your queries, your account data) are yours. We don't claim ownership of your queries or the personal collection you build.

What's ours and our publishers': The compose engine, Masthead's brand, the editorial selection of publications, and Masthead's product code are owned by Masthead. The articles cited in dossiers are owned by their respective publishers; Masthead serves them under licence from those publishers, and we credit them in every citation.

What you can do with composed dossiers: Compose dossiers are licensed to you for personal reading and reference. You may save, share with non-Members in reasonable quantity, or quote from them with attribution to Masthead and the cited publishers. Bulk redistribution, commercial republishing, or systematic harvesting of dossier content for resale or training other AI systems is not permitted.

8. Privacy

We process your account information, payment details, and usage data to operate the service. Our privacy practices are described in our Privacy Policy at masthead.studio/privacy.

In summary:

— We collect your email, name, payment information (handled by Stripe; we don't store full card details), and usage data (queries you submit, dossiers you compose, what you save)

— We use this data to operate and improve the service, send you transactional and account communications, and where you've opted in, marketing communications

— We don't sell your data to third parties

— We retain account data while your Membership is active and for 24 months after cancellation, after which we delete or anonymise it

— You have rights under EU GDPR and similar laws, including access, deletion, and portability — exercise them by emailing info@masthead.studio

9. AI compose disclosure

Masthead uses AI models (currently Anthropic's Claude and OpenAI's models) to compose dossiers. This means:

— Composed dossiers are AI-generated text, drawing on cited articles

— Every claim in a dossier should be cited; if a citation is missing or wrong, please flag it

— Despite our quality controls, AI compose can occasionally hallucinate or misattribute. Treat dossiers as a research aid, not a substitute for reading the original cited articles

— We log compose queries and responses for quality monitoring and improvement

10. Liability

Masthead's total liability under these Terms is limited to the amount you have paid in Membership fees in the 12 months prior to a claim arising. We are not liable for indirect, consequential, or punitive damages.

This limitation does not apply where excluded by applicable consumer protection law.

11. Changes to these Terms

We may update these Terms with at least 30 days' notice to your registered email address. Continued use of Membership after the notice period constitutes acceptance. If you don't accept changes, you may cancel before they take effect.

The current version of these Terms is always available at masthead.studio/terms.

12. Governing law

These Terms are governed by the laws of the Republic of Cyprus. Disputes are first to be resolved by good-faith negotiation. Where unresolved, disputes are subject to the non-exclusive jurisdiction of the courts of Cyprus, except where applicable consumer protection law of your jurisdiction provides for different forum or governing law for consumer disputes.
